Os advogados de Daniela sustentam que j\u00e1 se passou um ano e dez meses desde o parecer da PGR e argumentam que a a\u00e7\u00e3o n\u00e3o apresenta complexidade que justifique a demora. Segundo a defesa, outras queixas-crime sob a relatoria de Nunes Marques tiveram tramita\u00e7\u00e3o mais r\u00e1pida.Na manifesta\u00e7\u00e3o encaminhada ao Supremo, os advogados citam a A\u00e7\u00e3o Penal n\u00ba 1053, na qual Eduardo Bolsonaro responde por publica\u00e7\u00f5es dirigidas \u00e0 deputada Tabata Amaral (PSB-SP).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A defesa de Daniela argumenta que os fatos possuem semelhan\u00e7as e afirma que o STF j\u00e1 reconheceu que conduta dessa natureza \u201ctipifica o crime do art. 139 do C\u00f3digo Penal e n\u00e3o est\u00e1 abrangida pela imunidade parlamentar material\u201d. Os advogados tamb\u00e9m mencionam que, nesse processo, Alexandre de Moraes votou pela condena\u00e7\u00e3o de Eduardo Bolsonaro, acompanhado por C\u00e1rmen L\u00facia, Fl\u00e1vio Dino e Cristiano Zanin, antes da suspens\u00e3o do julgamento em raz\u00e3o de pedido de vista de Andr\u00e9 Mendon\u00e7a.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A defesa cita ainda a A\u00e7\u00e3o Penal n\u00ba 2782, na qual Eduardo Bolsonaro foi condenado pela Primeira Turma do STF a quatro anos e dois meses de reclus\u00e3o, al\u00e9m de multa.
